Classification and Categorization

Currently, Andalusian legislation only recognises two types of land: rural and urban. To be classified as urban, a piece of land must be integrated into an urban network and, in addition, meet one of the following requirements:

  • to be urbanised
  • to be connected to the urban road network and to the basic service networks
  • to be already built up, occupying more than 2/3 of the occupiable area.

Traditional rural sectors legally established are also considered urban land, provided that they serve as support for an urban settlement and have road access and basic services. The land classified as urban in the current planning is also considered urban. Basic services include the supply of drinking water, the supply of electricity and the evacuation and treatment of wastewater. As for rural land, its classification is assigned to all land that is not urban. In rural land, the following categories are distinguished:

  • specially protected by sectoral legislation
  • preserved by the existence of natural or anthropic processes that generate risks
  • preserved by territorial urban planning
  • common rural land.

The different categories may be held on the same land, in which case the conditions that guarantee compliance with all applicable provisions will apply.

Urban Planning Parameters

Among the parameters that can be set by the particular building ordinances are the following:

  • required previous studies
  • minimum / maximum plot area
  • minimum length facade
  • minimum diameter inscribed
  • maximum number of houses
  • minimum number of social houses
  • building type
  • maximum height, in meters and number of floors
  • minimum height
  • buildable Gross Floor Area
  • maximum occupation on the ground floor level and / or in other levels
  • minimum separation to private and public boundaries
  • minimum separation between buildings
  • maximum buildable depth
  • setbacks from alignments
  • minimum conditions for yards
  • outgoing parts or elements
  • predominant compatible and / or prohibited uses
  • minimum parking spaces
  • level of protection.
